1. Agreement to Terms

By accessing or using the Choose FI Media, Inc. (doing business as "ChooseFI") website (choosefi.com), mobile applications, community platform, and related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

2. Eligibility

You must be at least 18 years old to use our Platform. By using the Platform, you represent and warrant that you meet this requirement.

3. No Professional Advice

All content on the Platform, including but not limited to articles, podcast episodes, discussions, community posts, financial projections, tools, calculators, and information shared by other members, is provided for informational and educational purposes only.

Nothing on the Platform constitutes:

• Financial, investment, or retirement planning advice;
• Tax, accounting, or legal advice;
• Real estate, insurance, or credit counseling; or
• Any other form of professional advice.

You should always consult with a qualified professional before making any financial, legal, tax, or investment decisions. Reliance on any information provided through the Platform is solely at your own risk.

ChooseFI is not a registered investment adviser, broker-dealer, financial planner, tax preparer, or licensed professional of any kind. The views and opinions expressed by contributors, podcast guests, community members, and hosts are their own and do not represent professional recommendations.

4. Use of Content

You may not reproduce, distribute, or republish any content from this website without prior written permission from ChooseFI.

5. User Accounts & Community

If you create an account on our Platform, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to provide accurate information and to not impersonate any other person or entity.

When participating in our community forums, you agree to communicate respectfully and refrain from posting content that is unlawful, defamatory, harassing, or otherwise objectionable.

6. Meetups, Events, and In-Person Gatherings

Assumption of Risk

The Platform enables members to organize and participate in in-person meetups, events, and group activities ("Events"). You acknowledge that participation in Events may involve inherent risks, including but not limited to physical activities, travel, consumption of food or beverages, exposure to illness, interactions with other attendees, and risk of bodily injury, disability, or death.

By participating in any Event, you acknowledge that you have voluntarily chosen to participate and that you freely assume all risks associated with your participation, whether or not described above.

ChooseFI Is Not a Party to Offline Arrangements

ChooseFI does not organize, host, sponsor, or supervise Events. Events are organized by individual members acting in their own capacity. ChooseFI is not a party to any offline arrangements, agreements, or activities that arise through use of the Platform.

ChooseFI does not conduct background checks on members, organizers, or event attendees, and does not attempt to verify the truth, accuracy, or reliability of information provided by any member.

Organizer Role

Local group organizers and event hosts are volunteer community members. They are not employees, agents, or representatives of ChooseFI. Organizers do not provide professional advice of any kind on behalf of ChooseFI, and their actions and statements at Events do not represent the views or policies of ChooseFI.

7. Release of Claims

To the fullest extent permitted by applicable law, you agree to release and hold harmless Choose FI Media, Inc., its owners, officers, directors, employees, agents, affiliates, and partners ("ChooseFI Parties") from any and all claims, demands, losses, damages, and liabilities (direct and consequential) ("Claims") arising out of or in any way connected with:

• Your participation in or attendance at any Event;
• Transportation to or from any Event;
• Your interactions with other members, whether online or in person;
• Any transaction or arrangement between you and any other member or third party;
• Any content, advice, or information shared by other members, organizers, or contributors; or
• Your use of the Platform or any tools, calculators, or projections provided through the Platform.

You also agree, to the fullest extent permitted by applicable law, to release organizers and event hosts from Claims based on their negligence arising out of or in any way connected with their role as organizer, their content, a local group, or an Event.

California Residents

If you are a California resident, you expressly waive and relinquish all rights and benefits under Section 1542 of the California Civil Code, which provides:

"A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

You understand and acknowledge that this waiver is an essential part of these Terms.

8. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless all ChooseFI Parties from any Claims made by any third party due to or arising out of:

• Your violation of these Terms;
• Your use, misuse, or abuse of the Platform;
• Your content;
• Your violation of any law, statute, ordinance, or regulation, or the rights of any third party;
• Your participation or conduct in any local group or Event; or
• Any financial, investment, or other decision you make based on information obtained through the Platform.

You agree to promptly notify us of any third-party Claims, cooperate in defending such Claims, and pay all fees, costs, and expenses associated with defending such Claims (including reasonable attorneys' fees).

9. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose.
• Upload or transmit content that is abusive, threatening, defamatory, obscene, or otherwise objectionable.
• Violate the rights of others, including intellectual property rights.
• Interfere with or disrupt the normal operation of the Platform.
• Provide financial, legal, tax, or investment advice while representing or implying that you are acting on behalf of ChooseFI.
• Solicit or collect personal data from other members except as necessary for the administration of a group or event.

10. Intellectual Property

The ChooseFI name, logo, and all related marks are trademarks of ChooseFI. All content, design, graphics, and other intellectual property on this site are owned by or licensed to ChooseFI and are protected by applicable copyright and trademark laws.

11. Third-Party Links & Affiliates

Our website contains links to third-party websites and services. These links are provided for your convenience. ChooseFI does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party sites.

12. Disclaimers

The Platform is provided on an "as-is" and "as-available" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the accuracy, completeness, or reliability of:

• User-submitted content, including financial information, opinions, and advice;
• Information shared at Events or in community discussions;
• Any tools, calculators, or projections available through the Platform; or
• The conduct, qualifications, or statements of any member, organizer, or contributor.

13. Limitation of Liability

To the fullest extent permitted by law, Choose FI Media, Inc. and all ChooseFI Parties shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to:

• Your use of the Platform or inability to use the Platform;
• Statements, conduct, or content of any member, organizer, or third party;
• Your attendance at, participation in, or exclusion from any Event;
• Transportation to or from any Event;
• The actions of you or others at any Event;
• Any financial, investment, tax, or other decision made in reliance on information obtained through the Platform; or
• Any other matter relating to the Platform.

Our total liability to you for any claims arising from or related to the Platform shall not exceed one hundred U.S. dollars ($100).

14. Dispute Resolution

Informal Resolution

Before filing any formal claim, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) business days.

Governing Law

These Terms are governed by the laws of the United States and the Commonwealth of Virginia, without regard to conflict of law principles.

Class Action Waiver

To the fullest extent permitted by applicable law, you agree to resolve any disputes with ChooseFI on an individual basis. You agree not to bring or participate in a class, consolidated, or representative action against ChooseFI.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the effective date at the top of this page and providing notice within the Platform or via email.

Your continued use of the Platform after any updates means you accept the new Terms.
